San Francisco Nov. 20, 2008 - The California Supreme Court today issued four orders in cases challenging Proposition 8.
The first order, issued in the three cases that the court agreed to hear yesterday, is designed to simplify the filing of amicus curiae ("friend of the court") briefs in those cases. The order states that "[i]n order to avoid the unnecessary filing of multiple identical copies of amicus curiae applications and briefs," the court will consider any amicus curiae filing in any one of the three cases in its determination of each of the cases.
Therefore, only one amicus brief needs to be filed in any one of the three cases.
The second, third, and fourth orders were issued, respectively, in each of the remaining petitions challenging Proposition 8 that the court did not act on yesterday. Each order defers further action on the matter pending further order of the Supreme Court, and also invites the parties to the action to seek to appear as amicus curiae in the cases the court has already agreed to decide.
