NEVADA CITY, Calif. June 22, 2010 - By a unanimous vote, the Nevada County BOS accepted to hear an appeal by Blue Lead Mine LLC regarding the denial of the vested right to mine. The appeal will be heard on August 10, 2010 at 1:30 p.m.
The attorney for Blue Lead, Braiden Chadwick, explained that his client will present new evidence showing the Planning Commission's decision was based on incorrect information. Chadwick cited two instances of evidence provided by the public, and used in the decision-making process, that he will attempt to refute at the BOS hearing.
Any vested mine does not need to apply for a mining permit to the county and no California Environmental Quality Act (CEQA) document for the mining operation itself is required. Another exemption concerns grading permits for roads, landing pads, staging areas, etc. Culverts and diversion ponds are also exempt from any oversight under the vested right to mine.
