Former Truckee Business Man Indicted For Failing To Pay More Than $730,000 In Taxes

SACRAMENTO, Calif. September 3, 2010 — United States Attorney Benjamin B. Wagner announced today that a federal grand jury returned a two-count indictment charging Phillip L. Kosh, 65, formerly of Truckee, now of Harrison, Ark., with attempting to evade taxes. The indictment alleges that Kosh received taxable income of over $3.9 million in 2001 and 2002, and that Kosh failed to pay income taxes of approximately $732,000.

This case is the product of an extensive investigation by the Internal Revenue Service-Criminal Investigation. Assistant United States Attorney Camil A. Skipper is prosecuting the case.

According to court records, Kosh was arrested in Harrison, Ark. and transported to Sacramento to face the charges. He was arraigned yesterday and is scheduled for a detention hearing at 2:00 p.m. today.

The maximum statutory penalty for a violation of attempting to evade or defeat tax is five years in prison and a fine of $100,000. The actual sentence, however, will be determined at the discretion of the court after consideration of any applicable statutory factors and the Federal Sentencing Guidelines, which take into account a number of variables.

The charges are only allegations and the defendant is presumed innocent until and unless proven guilty beyond a reasonable doubt.
